The 46th session of the HaiRan Foundation Academic Lecture Series: Professor Shan Yong from School of Law of Nanjing University was Invited to give lectures

On September 25, Professor Shan Yong of Nanjing University Law School was invited to give a lecture at our college. The theme of the lecture is "Crime Governance Transformation and Legal Changes in the Digital Age: A Case Study of the Gatekeeper Rule". The lecture was presided over by Professor Zhang Jian of the School of Law of Jiangsu University, with Associate Professor Wu Qiuyuan, Associate Professor Shentu Xiaoli, and Associate Professor Lei Wanlu as discussants, and more than 50 teachers and students attended the lecture.

At the beginning of the lecture, Professor Shan Yong focused on the transformation of legal research from departmental law to domain law, citing the case of "prevention of murder", pointing out that traditional criminal law is dominated by "responsive" thinking and focuses on legal regulation after the crime, while in the context of the digital age, legislative practice is increasingly showing "preventive" characteristics. He cited laws and regulations such as the Anti-Telecommunications Network Fraud Law, the Cybersecurity Law, and the Regulations on the Prevention and Resolution of Conflicts and Disputes in Jiangsu Province, emphasizing that the current legal system is gradually shifting the focus of governance to source prevention and risk control.

Subsequently, Professor Shan Yong explained the positive role of information technology in improving the efficiency of crime governance by analyzing the practices of "Hangzhou City Brain", "Future Police Station" and "Big Data Anti-Corruption". At the same time, it is pointed out that information technology may be abused by criminals, resulting in a change in the law of crime from "urban attraction" to "network attraction". Based on this, Professor Shan further analyzed the types of Internet crimes such as infringing on property rights and interests and undermining the security of computer information systems.

Finally, Professor Shan Yong focused on the crime of the Internet black and gray industry, reflected on the limitations of the scope of action, prevention effect, and governance subject in the traditional criminal legal system, and then proposed a new path of governance with the "gatekeeper rule" as the core.

During the discussion session, Professor Shan Yong responded to the questions of Wu Qiuyuan and other teachers in depth, and the lecture site had a strong academic atmosphere and warm interaction. The lecture ended successfully with applause.

Professor Shan Yong is a professor and doctoral supervisor at the School of Law of Nanjing University, and the deputy director of the Institute of Crime Prevention of Nanjing University. He was awarded the title of the Fifth Young Jurist of Jiangsu Province and was selected as the third level of the Jiangsu Provincial 333 Talent Project. He has published more than 40 papers in journals such as China Law, Legal Research, and Sociological Research, presided over 2 projects of the National Social Science Foundation, and presided over 13 provincial and ministerial projects.
