On April 23, the press conference on judicial protection of intellectual property rights and the symposium on judicial escort innovation exchange were successfully held at Jiangsu University. With the theme of "Judicial Escort Innovation and Intellectual Property Talking about the Future", Yang Yi, President of the First Civil Division of the Jingkou District People's Court, and representatives of cadres and police, Shang Qingfeng and Zhou Aichun, associate professors of the Law School of Jiangsu University, Zhu Hua and Wang Xing, deputies to the District People's Congress, and Li Hong, member of the District Committee of the Chinese People's Political Consultative Conference, attended the symposium, and many media participated in the report.
Yang Yi, President of the First Civil Division of the Jingkou District People's Court, reported on the intellectual property trial work in 2024. He pointed out that the Jingkou Court closely follows the innovation-driven development strategy, focuses on the goal of "efficient protection, strict protection, and coordinated protection", and pays attention to the unity of legal and social effects and effectively regulates the market order by optimizing the trial mechanism, strengthening the governance of litigation sources, and carrying out special actions for the "two-way protection" of intellectual property rights of small and micro enterprises. Demonstration adjudication of typed cases first, actively implement demonstration adjudication mechanisms, efficiently resolve disputes in batches, achieve efficient resolution of batch cases, and improve the quality and efficiency of trials.
The court has always adhered to the principle of "combination of mediation and judgment" and innovatively adopted the flexible mediation method of "face-to-face, back-to-back, and point-to-point". Last year, a total of 274 intellectual property cases were concluded, including 39 mediation cases and 177 withdrawal cases, with a case withdrawal rate of 78.8%, and nearly 80% of the cases withdrawn were agreed upon through court mediation, achieving the unity of legal and social effects. Yang Yi said that he will continue to deepen judicial protection and provide a more solid guarantee for innovation and development.
At the meeting, two typical cases of intellectual property rights were released to provide clear guidance for judicial practice and market entities: "Zhangjia Moumou" trademark infringement case: a hotel used a similar trademark logo, and the court found that it constituted infringement, and the judgment stopped the infringement and compensated. This case draws a clear boundary for the use of commercial logos in the local characteristic catering industry and enhances the awareness of trademark protection. Online unfair competition dispute case: A software company's technical means hindered the normal operation of the platform, and the court found that it constituted unfair competition, rejected the plaintiff's claim, and drew a compliance red line for competition in the Internet field.
Zhou Aichun, associate professor of Jiangsu University Law School, and judge representatives conducted an in-depth discussion on "determination of copyright infringement of hotel projection equipment". In response to the focus of disputes such as "whether the provision of projection equipment by hotels for guests to broadcast film and television works on demand constitutes infringement" and "the distinction between the right to display and the right to disseminate information networks", the two sides pointed out that it is necessary to refine the application of law in combination with the relevant judicial interpretations and judicial practices of the Supreme People's Court, and balance the interests of right holders and the needs of public use. Zhu Hua and Wang Xing, deputies to the District People's Congress, and Li Hong, a member of the Chinese People's Political Consultative Conference, suggested strengthening pre-compliance guidance, improving the collaborative protection system, dynamically adapting to technological changes, improving the intellectual property protection mechanism, and avoiding "regulatory lag".
This symposium gathered consensus on intellectual property protection through "theoretical discussion + case guidance + practical exchange". The Law School of Jiangsu University said that it will take this meeting as an opportunity to deepen discipline education, strengthen social coordination, escort the creation, application and protection of intellectual property rights with high-quality legal education, and inject rule of law momentum into the innovation-driven development of Zhenjiang City.
